Violations and Penalties under R.A. 11032ViolationsPenalties

Alamin at sundin ang batas. Narito ang mga paglabag sa ilalim ng R.A. 11032 at ang mga karampatang parusa sa mga ito.

Violations

  • (A) Failure to set up the most current and updated Citizens Charter;
  • (B) Violation of the Zero-Contact Policy;
  • (C) Selling, offering to sell, or recommending specific brands of fire extinguishers and other fire safety equipment to any applicant or requesting party or business entity by the Bureau of Fire Protection or any of its official or employees;
  • (D) Refusal to accept application or request with complete requirements being submitted by an applicant or requesting party without due cause;
  • (E) Imposition of additional requirements other than those listed in the Citizen’s Charter;
  • (F) Imposition of additional costs not reflected in the Citizen’s Charter;
  • (G) Failure to give the applicant or requesting party a written notice on the disapproval of an application or request;
  • (H) Failure to render government services within the prescribed processing time on any application or request without due cause;
  • (I) Failure to attend to applicants or requesting parties who are within the premises of the office or agency concerned prior to the end of official working hours and during lunch break;
  • (J) Failure or refusal to issue official receipts;
  • (K) Fixing and/or collusion with fixers in consideration of economic and/or other gain or advantage;

Mga paglabag

  • (A) Kabiguang i-set up ang pinakabago at updated na Citizen’s Charter;
  • (B) Paglabag sa Zero-Contact Policy;
  • (C) Pagbebenta, pag-aalok para magbenta, at pagrerekomenda ng Bureau of Fire Protection o sinuman sa mga opisyal o empleyado nito sa sinumang aplikante ng mga tukoy na tatak ng fire extinguisher o anumang gamit para sa kaligtasan laban sa sunog;
  • (D) Pagtanggi na tanggapin ang aplikasyon o kahilingan ng isang aplikante, na kumpleto na ang mga rekisito, nang walang sapat na dahilan;
  • (E) Pagpapataw ng mga karagdagang rekisito maliban sa nakalista sa Citizen’s Charter;
  • (F) Pagpapataw ng mga karagdagang gastos na hindi nakasaad sa Citizen’s Charter;
  • (G) Kabiguang bigyan ang aplikante ng isang nakasulat na abiso sa hindi pagsang-ayon sa isang aplikasyon o kahilingan;
  • (H) Pagkabigo na makapagbigay ng mga serbisyo ng gobyerno sa loob ng takdang oras ng pagproseso sa anumang aplikasyon o kahilingan nang walang angkop na dahilan;
  • (I) Kabiguang tugunan ang hiling ng aplikanteng nasa loob ng tanggapan o ahensya ng gobyerno sa opisyal na oras ng pagtatrabaho, kabilang ang lunch break o tanghalian;
  • (J) Pagkabigo o pagtanggi na mag-isyu ng mga opisyal na resibo;
  • (K) Fixing at pakikipagsabwatan sa mga fixer sa ngalan ng kita o iba pang pakinabang o kalamangan;

Under ARTA, we will be implementing a 2 STRIKE policy for government officials and employees found in violation of EODB/EDGSA:

FIRST OFFENSE: Administrative liability with six (6) months suspension. Except for fixing or collusion with fixers where the Revised Penal Code shall apply.

SECOND OFFENSE: Administrative and criminal liability

  • Dismissal from the service.
  • Imprisonment of one (1) year to six (6) years.
  • Perpetual disqualification from holding public office.
  • Fine of not less than P500K.
  • Forfeiture of retirement benefits but not more than P2M.

Any person who commits any act such as but not limited to bribery, extortion or malicious solicitation of favor shall be criminally liable and shall be punished under the Revised Penal Code and other special laws.
